Terms and Conditions of The Kitano Hotel’s Internet Reservation System

This page contains the agreement governing usage of the The Kitano Hotel’s Internet Reservation System (hereinafter referred to as “this Agreement”). The following terms and conditions of Kitano Hotel’s Internet Reservation System (hereinafter referred to as the “System”) is established and operated for customers (hereinafter referred to as the “User”) of The Kitano Hotel Tokyo (hereinafter referred to as the “Hotel”) by Kitano Godo Tatemono Co., Ltd. The User of the System agrees to comply with this Agreement in full and will use the System in accordance with this Agreement.

Article 1 (Observance of Basic Rules)

• When using the System, the User is required to observe generally accepted manners, morals and technical regulations for using internet.
• The use of the System for commercial purposes, such as making reservations for a third party for profit, is strictly prohibited.

Article 2 (Violation of Basic Rules)

If the User caused damage to the third party or the Hotel’s service, the User will not be permitted to use the System.

Article 3 (Troubles Caused by User’s Computer Environment)

Use of the System is limited to those who have properly set-up applications, such as email, on their electronic devices. The Hotel shall not be held responsible for any losses or damages resulting from the use of improperly set-up electronic devices. The Hotel shall also not be held responsible if the System does not operate properly due to causes beyond the Hotel’s control, including but not limited to, any issues associated with the User’s electronic device or internet access settings, even under circumstances that are in accordance with the conditions mentioned above.

Article 4 (Conditions Governing Use of System)

Use of the System is limited to those who agree in full to this Agreement.
When the User makes reservations through the System, the User has been deemed to agree to this Agreement in full and will use the System in accordance with this Agreement.

Article 5 (Services Provided by System)

The User can reserve certain services that the Hotel offers on the web site operated by Kitano Godo Tatemono Co., Ltd. (hereinafter referred to as the “Kitano Hotel Web Site”).

Article 6 (Compliance with Terms When Using Reserved Services)

The User shall comply with the General Terms and Conditions for Accommodation Contract, the Use rule and any other terms of service established separately by the Hotel when using reserved services.

Article 7 (Priority of System Reservations)

Reservations requested through the System shall not be extended priority over reservations made through other means (i.e. by telephone or through the hotel reservation website, etc.).
Therefore, some reservation requests made through the System may not be accepted when services are not available due to being sold out.

Article 8 (User Responsibilities)

• The User shall be responsible for their conduct and the results of any conduct (regardless of and negligence) realized through their e-mail account. Furthermore, if the User causes a third-party damage by using the System, except in such instances where the result is due to the Hotel’s negligence, the User shall be responsible for such damages and must settle all disputes with the concerned third party at their own responsibility and expense.
• The Hotel retains the right to claim damages and require the User to pay damages when the User causes damage to the Hotel and/or the System due to any of the following conduct:

  Breach of this Agreement, the Hotel’s General Terms and Conditions for Accommodation Contract, Use rule or any other terms of service established separately by the Hotel;

  Transmission or writing-in of harmful computer programs;

  Transmission or writing-in of a third party’s information;

  Use of the System for purposes other than the User’s personal purposes without the Hotel’s consent; and

  Any conduct in violation of Japanese law.

Article 9 (Confirmation of Reservation)

Reservations through the System is established and confirmed when the User registers such reservation and the Hotel send the reservation confirmation to the User by e-mail.

Article 10 (Cancellations and Changes to Reservations)

Any cancellation or amendment to a reservation through the System shall be accomplished by using the System. If the System is not available due to unavoidable circumstances, please contact the Hotels by phone. In such case, the notice of such cancellation or amendment is not send to the User by e-mail.

Article 11 (Cancellation Fee)

When the User cancels a reservation for their own reason, the relevant User shall pay the following cancellation fee.
1 Day Prior to Arrival Day after 4:00 p.m. 100%
Arrival Day 100%
No show 100%

Article 12 (Items Needed When Using the System)

To use the System, the User must have the following items:-

• An e-mail account, which can be used for sending and receiving e-mails; and
• An electronic device such as a PC or smartphone, with internet capability.

Article 13 (Making Reservation)

• The User is required to enter all the required personal data on the reservation form provided online.
• If the entered personal data is insufficient or inaccurate, the reservation will not be valid.

Article 14 (Changes to the System)

The operation of the System, or the System itself, may be changed without prior notice to the User when it is deemed necessary by the Hotel. The User is required to read this Agreement each time they use the System. After the content of this Agreement has been changed, only the content as changed shall be effective; the content before the change shall be invalid.

Article 15 (Suspension of System)

The Hotel may temporarily suspend the System without prior notice to the User or without the Users’ consent when:-

• the maintenance or upgrading activity is conducted on the System;
• natural disaster, force majeure or any other emergency occurs, or when there is a danger of such emergency, and it results in difficulty operating the System; or
• the Hotel deems it is necessary to suspend the System for reasons related to operations of the Kitano Hotel Web Site or the System itself.

Article 16 (Governing laws)

The System shall be operated and used in accordance with the laws of Japan.

Article 17 (Amendment of this Agreement)

• This Agreement corresponds to the standard contract terms and conditions provided in the Civil Code. The provisions within this Agreement may be amended in accordance with the provisions of the Civil Code when it is to the general benefit of the User, or there are reasonable grounds for such amendment.
• When this Agreement is amended, the amended provisions shall be displayed on the Hotel’s web site. The amendment of this Agreement becomes effective on the effective date listed in said web site.

Article 18 (Validity of this Agreement)

This Agreement becomes effective on November 16, 2020 (Japan Standard Time).
